SPEAKER: Your Committee on Ways and Means, to whom was referred Senate Bill No. 462-An Act to provide a system of irrigation, promote rapid drainage, and improve the navigation of the Sacramento and San Joaquin Rivers-have had the same under consideration. Five members present and voting; the majority, consisting of Messrs. Waters, Kercheval, and Garver, report it back, recommending its passage; Messrs. Nott and Tuttle voting "no."

And Assembly Bills Nos. 300-An Act to promote the sanitary condition of towns and villages in Fresno County.

306-An Act to amend an Act entitled an Act to provide for the completion of the building in the City and County of San Francisco known as the New City Hail, approved March twenty-fourth, eighteen hundred and seventy-six.

312-An Act to authorize the Board of Supervisors of Marin County to levy a special tax, and

to appropriate the moneys collected thereunder to the construction of a wagon road in said county, and to transfer certain funds.

314-An Act to authorize the Board of Supervisors of Los Angeles County to purchase a farm in the County of Los Angeles, to build and establish a County Alms-house and Hospital thereon, and to issue bonds for the payment of the same.

STATE OF CALIFORNIA EXECUTIVE DEPARTMENT.

I desired, on Saturday, the sixteenth instant, to return to your honorable body Assembly Bill No. 245-entitled an Act authorizing the Board of Supervisors of Los Angeles County to allow the claim of Dionisio Botello, ex-Assessor of said county, for services rendered said county during the years eighteen hundred and seventy and eighteen hundred and seventy-one-without my approval, accompanied by a message stating therein my objections to it. When E. W. Maslin, my Private Secretary, reached the Assembly Chamber, the Assembly was not in session, having adjourned for the day, and he, accordingly, on the said sixteenth instant, at the hour of one o'clock and thirty-five minutes P. M., delivered the said bill and the said message to the Honorable C. P. Berry, the Speaker of the Assembly.

I herewith respectfully return to your honorable body Assembly Bill No. 102-entitled an Act to authorize the Board of Supervisors of Humboldt County to pay the claim of Abner D. Sevier, ex-Sheriff of said county-without my approval.

This bill is identical in character with Assembly Bill No. 245, which I have already returned, without my approval, and with my reasons for withholding it. Those reasons need not be stated at length again. It will be sufficient to show that the present bill falls into the same category as the other.

The Angney Fee and Salary Bills, so-called, were approved March twenty-eighth, eighteen hundred and sixty-eight, with the proviso that they should take effect on the first Monday of March, eighteen hundred and seventy. The one prescribed the fees which the county officers of the several counties might lawfully charge and collect for their services; the other fixed the salaries or other compensations which such officers would be entitled to receive to their own use. The provision of the Salary Act, applicable to Humboldt County, was as follows:

"SECTION 7. In all cases the mileage allowed by law to any Sheriff shall belong to and be retained by him for his own use and benefit # And he shall receive, to include the pay of deputies and Jailer, in addition to mileage allowed by law, the fees, commissions, and percentage, as provided in the Act to regulate the fees of office, approved March twenty-eighth, eighteen hundred and sixty-eight, and the percentage herein allowed for the collection of taxes, to the amount in the aggregate of thirty-eight hundred dollars per annum, which shall be in full compensation for all services rendered by him, or his deputies, or assistants, as Sheriff and ex officio Tax Collector."

Mr. Sevier was elected Sheriff of Humboldt County at the general election in September, eighteen hundred and sixty-nine, and entered into his office on the first Monday in March, eighteen hundred and seventy. At the session of the Legislature of eighteen hundred and sixtynine and seventy, the Angney Fee and Salary Acts were repealed, with respect to some counties, and greatly modified with respect to others. For the Sheriff of Humboldt County a new fee bill was provided, but the fees allowed by it were, in the main, those provided in the Angney Fee Bill; and in most of the few instances in which changes were made the fees were raised. The compensation of the Sheriff, however, as fixed in the Angney Salary Act, was left undisturbed by the Legislature of eighteen hundred and sixty-nine and seventy.

This bill assumes that Mr. Sevier did not receive compensation for the services of the Jailer, which he was compelled, under the law, to employ. The Board of Supervisors of the county,
