concerns will have an equitable opportunity to compete for subcontracts.

d. Assurances that the offeror will include the clause entitled
Utilization of Small Business and Small Disadvantaged
Business Concerns in all subcontracts which offer further
subcontracting possibilities in the United States and will
require all subcontractors (except small business concerns)
who receive subcontracts in excess of $500,000, or in the
case of a contract for the construction of any public
facility, 51 million, to adopt a plan in consonance with
this clause.

Assurances that the offeror will submit such periodic reports and cooperate in any studies or surveys as may be required by the contracting agency or the Small Business Administration in order to determine the extent of compliance by the offeror with the subcontracting plan.

A recitation of the types of records the offeror will maintain to demonstrate procedures which have been adopted to comply with the requirements and goals set forth in the plan, including the establishment of source lists of small business and small disadvantaged business concerns; and efforts to identify and award subcontracts to such small business concerns. The records shall include at least the following (these records may be maintained on a plant-wide or company-wide basis unless otherwise indicated).

EFFECT OF NONCOMPLIANCE

The failure of any contractor or subcontractor to comply in good faith with the clause described in paragraph A.1. when the clause incorporated in the contract or the subcontract or with an approve plan required as stated in paragraph D.1. or D.2. will be a materi breach of the contract or subcontract.

When FCA is the apparent low bidder in response to a formally advertised solicitation containing a requirement for submission of a small and small disadvantaged business subcontracting plan, it shall suamit such a plan upon request. Failure to submit the subcontracting plan shall make RCA ineligible for award. As a minimum, the plan shall satisfy the requirements described in paragraph D.1. a.-f.

IMPLEMENTATION OF SUBCONTRACTING PLAN

In order to implement effectively the plans described in paragraph D.1. and D.2., the contract clause provides that the contractor shall:

Issue and promulgate company wide policy statements in support of this effort, develop written procedures and work instructions, and assign specific responsibilities regarding requirements of this clause.

Demonstrate continuing management interest and involvement in support of this effort through such actions as regular reviews of progress and establishment of overall corporate and divisional goals and objectives.

contract over $10,000.

In addition, for each contract $500,000 or acre
($1,000,000 or more for construction), submit and
negotiate an acceptable subcontracting plan for smell
and small disadvantaged business concerns. Included
in this plan will be separate percentage goals for each
type of business concem and a comprehensive descrip-
tion of efforts to be made to achieve these goals.
