AN ACT

For the relief of Archibald S. Jordan.

SECTION 1. Be it enacted by the Senate and House of Representa tives of the Commonwealth of Pennsylvania in General Assembly et, and it is hereby enacted by the authority of the same, That the auditor general be and he is hereby authorized to examine the claim of Archibald S. Jordan, brigade inspector of the first brigade, sixth division, Pennsylvania militia, for services rendered in summoning and holding a court martial, for the trial of delinquent militia men at the borough of York, in the year one thousand eight hundred and fifteen, and to draw his warrant on the state treasurer for such an amount, (if any) as the said Archibald S. Jordon shall be found entitled to receive; which warrant shall be paid by the state treasurer, out of any money in the treasury not otherwise appropriated: Provided, The auditor general is satisfied that the same has never been paid.

AN ACT

Fixing the time for holding borough elections in Bradford county.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the borough elections in the county of Bradford, shall hereafter be held on the third Friday in January in each year; and the election held on the third Friday of January, eighteen hundred and forty-seven, in the borough of Towanda, be and the same is hereby made valid.

AN ACT

Authorizing the supervisors of Passyunk township, in the county of Philadelphis, to regulate and pave the Gray's Ferry road, from Cedar street to Federal street, in the said township.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the sume, That whenever the owners of ground, comprising one half of the actual front on the Gray's Ferry road, from Cedar street to Federal street, in the township of Passyunk, shall require it, it shall be the duty of the supervisors of the said township, to proceed without unnecessary delay, to grade, regulate, curb and pave the same, according to the established regulation of lines and heights, in a workmanlike manner, of good materials, according to the method now practised in the city of Philadelphia and the adjoining districts.

SECTION 2. The cost of grading and regulating the entire width of Costs, how to be the said road or street, ready to receive the pavement, to be paid for by paid. the said township; and the cost of curbing and paving the said road or street and footways, to be paid for by the owners of the ground respec

tively, in proportion to the actual front thereon that may be owned by

each.

SECTION 3. The cartway of the said road or street, to be kept in good Repairs, by order and repair at all times hereafter, at the proper cost and charge of whom to be made the said township; and the curb and footway to be kept in good order

and repair at all times hereafter, by the owners respectively, of the ground fronting on the same.

SECTION 4. That if any owner of property, fronting on said Gray's Ferry road, shall refuse or neglect to make payment of the amount due, by reason of the said paving, then it shall be lawful for the said super

visors to file their lien for the same, in any court of the city and county Liens to be filed. of Philadelphia having jurisdiction of the amount, and collect the same

by action of debt, or proceedings by scire facias, in the same manner as

is now provided by law, for the collection of municipal claims by the

several incorporated districts of the county of Philadelphia: And pro- Proviso.
vided also, That the amount due from individuals, by reason of the
said paving, together with all proper charges, shall be a lien upon the
property of the several owners, in proportion to the actual front of their
respective properties on the said Gray's Ferry road; and shall have
priority to and be fully satisfied, before any incumbrance to which the
said estate may become liable, after the passing of this act.

AN ACT

Authorizing the burgess and town council of the borough of Schuylkill Haven, in the county of Schuylkill, to provide a lock-up house.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That

common prison of said county, if committed for an indictable offence, or until discharged according to law: Provided, That no person or persons, shall be confined in said lock-up house at any one time for a longer period than twenty-four hours, except such person or persons be charged with an indictable offence, and it may be necessary to detain him, her or them for a legal examination.

SECTION 2. That the expense of arresting, binding over or committing and keeping any such person or persons in the said lock-up house, or conveying him, her or them to the common jail of the county aforesaid, on any indictable offence, shall be paid by the county of Schuyl kill, on the presentation of proper accounts of the same to the commissioners of said county.

Preamble.

AN ACT

To transfer a certain lot and building to the comptrollers of public schools, in the first school district composing the city and county of Philadelphia.

WHEREAS, A certain Andrew Allen and Maria, his wife, by a certain deed of indenture, bearing date the fifth day of February, Anno Domini, one thousand seven hundred and ninety-eight, recorded in deed book I W, number seven, page twenty-one, et cetera, granted and conveyed a certain lot or piece of land, situate in the township of Germantown, in the county of Philadelphia, at Mount Airy, containing one quarter of an acre and eight perches of land, more or less, unto Henry Sweyer, Joseph Miller and Jonathan Yerkes, in trust, for the use of the neighborhood in general, to be a place for any English school, and for no other purposes:

And whereas, The said trustees having deceased, new trustees were elected by the inhabitants of said township from time to time, to carry out the intention of the donor:

And whereas, Since the adoption of the public school system within said township, the said school house and appurtenances have been rented to the directors of the sixth section of the first school district, for the purposes of a public school house :

And whereas, It is desirable that said lot of ground should be vested in the board of comptrollers for the first district of public schools; therefore,

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That

Gorgas, trustees elect of Mount Airy school, in the township of Germantown aforesaid, or a majority of them, be and are hereby authorized to grant and convey the lot of land, and buildings thereon erected with the appurtenances, unto the comptrollers of the public schools of the city and county of Philadelphia, composing the first school district of Pennsylvania, as before described in the preamble to this act, under and subject to the provisions of the deed of conveyance aforesaid, and for the uses and purposes therein stipulated and contained in fee simple, to them and their successors forever.

AN ACT

Relative to justices of the peace of the borough of Meadville.

SECTION 1. Be it enacted by the Senate and House of Representatives of the Commonwealth of Pennsylvania in General Assembly met, and it is hereby enacted by the authority of the same, That the official acts of the justices of the peace of the different wards of the borough of Meadville, in the county of Crawford, since the division of said borough into wards, shall not be invalid by reason of said justices, or any of them, residing out of the proper ward; and that all acts and proceedings of such justices be and are hereby confirmed, and shall be as good and legal for all purposes as if said justices had resided in the proper ward; and that hereafter the residence of the justices of the peace, of the different wards in said borough, or any of them, shall not be confined to the proper ward: Provided, That nothing herein con- Proviso. tained shall be construed to authorize the said justices to keep their offices out of the ward, for which they may have been or shall be commissioned.
