troubled or molefted, under any pretence, for having borne arms in the defence of the province.

XX. Two covered waggons fhall be granted to march out with the troops, which are not upon any account whatever to be fearched. Granted.

XXI. All the cattle, and other provifions whatsoever, taken from the inhabitants of faid province, for the use of his Catholic Majesty's forces, fhall be paid for in full, according to the customary prices for each respective article in the parts where the fame have been taken.

This article useless, as neither cattle nor any thing else has been taken from the inhabitants.

XXII. That the Governor and Commander of the troops in this province shall be permitted to fend advice of this capitulation in flags of truce or otherwife, at their option, to the Governor of East Florida, the Commander in Chief in North America, to Jamaica, and Great Britain, if they fhall think proper fo to do.

Granted.

XXIII. All prifoners made by the arms of Spain, fince the 9th day of March laft, fhall join the garrifons of the forts and pofts to be evacuated, and be on the fame footing as ftipulated for them in the first article; and all Spanish prifoners who had paroles given them at Pensacola, or who are now in poffeffion of the British troops, to be fet at liberty, unless fuch as fhall be accused of, and excepted againft, for breach of parole.

XXIV. Negroes who have abfconded during the fiege from fear or apprehenfions of danger, to be reftored to their owners, when found.

Granted, or if found inconvenient, their value fhall be given.

XXV. Quarters to be provided for the British troops and feamen, until they can be embarked on board the tranfports to be furnished for them by the first article.

Granted.

XXVI. The full and entire execution of the prefent capitulation fhall be obferved, bona fide, and where doubt fhall arife, not provided for in the preceding articles, it fhall be understood to be the intention of the contracting parties, that they be determined in the manner moft conformable to humanity and liberality of fentiment.

Additional Articles.

XXVII. In case of one or more British failors or foldiers, who are now abfent from their refpective corps, and wandering in the woods, fhall hereafter be taken by the Spanish troops, or their allies, they shall be confidered the fame as if they actually now were a part of the garrifon, and as fuch (in cafe they fhall be taken before the departure of the garrifon) fhall be fuffered to join the British troops;

and

and if after their departure, they fhall be allowed to join the hofpital, and be fent to the fame port to which the garrifon fhall retire, along with the fick and wounded, who fhall be left behind, agreeable to the ftipulation of the third article.

Granted, provided they do not present themselves in quality of deferters.

XXVIII. No encouragement whatever fhall be given, nor, upon honour, any means ufed, to entice either foldiers or failors of the British troops, to enlift in the fervice of Spain, or that of their allies.

Granted, but protection fhall be afforded to them who prefent themselves voluntarily.

Note 227. Propofitions offered to the commanding officers of the British navy and troops, in Cape Fear River, by such of the inhabitants of the town of Wilmington and others who choose to remain there.

ARTICLE I. The inhabitants and others remaining there to be prifoners of war, until regularly exchanged.

ART. II. The inhabitants to remain in town, and to have their properties, of every denomination, secured to them, and their perfons protected.

Mr James Walker, and Mr John Du Bois are appointed to prefent these proposals.

The commanding officers of his Majesty's navy and troops in Cape Fear River, in answer to a meffage,received from the inhabitants of Wilmington, have only to obferve, that, in the prefent fituation of affairs, they are not entitled to a capitulation, nor are the articles offered them fuch as could be received in that light. When his Majesty's forces appear before the town, they must submit to be prifoners of war at difcretion, or take the confequence of refiftance: in the former cafe, every exertion will be used to prevent plunder, or perfonal ill ufage to any perfon whatever.
