88. Pursers in the navy of the United States shall hereafter be styled paymasters, 22 June 1860 § 3. and all laws and regulations applying to them as pursers, and all responsibilities and obligations attaching to them as such shall remain in full force and continue to Pursers to be styled paymas apply to them under the title of paymasters. 90. On other duty, for the first five years after date of commission, one thousand dollars; after five years from date of commission, one thousand two hundred dollars.

On leave of absence or waiting orders, for the first five years after date of commission, eight hundred dollars; after five years from date of commission, one thousand dollars; and when attached to vessels for sea service, each assistant paymaster shall be entitled to one ration per day.

92. 93. 96. Every assistant paymaster attached to a vessel of war shall be allowed a clerk, 3 March 1963 ₫ 5 with the compensation and privileges which would be given by law to the clerk of a paymaster, if attached to the same vessel: Provided, That clerks shall not be allowed Assistant payto paymasters or assistant paymasters in vessels having complements of less than one hundred, excepting in supply steamers or store-ships.

98. The active list of the pay corps of the navy shall consist of eighty paymasters, forty passed assistant paymasters, and thirty assistant paymasters. Paymasters shall be regularly promoted and commissioned from passed assistant paymasters, and passed assistant paymasters from assistant paymasters; and all passed assistant paymasters authorized by this act to be appointed, who have not heretofore been appointed and commissioned as assistant paymasters, and all assistant paymasters hereby authorized to be appointed, shall be selected from those who have served as acting assistant paymasters for the term of one year, and who were eligible to appointment in the grade of assistant paymasters, when they were appointed acting assistant paymasters, as aforesaid; subject, however, to such examinations as are required by law, and such as may be established by the secretary of the navy.

99. Passed assistant paymasters shall give bonds for the faithful performance of their duties in the sum of fifteen thousand dollars; and their annual pay shall be, at sea, fifteen hundred dollars; on other duty, fourteen hundred dollars; on leave or waiting orders, twelve hundred dollars.

100. The appointments to be made under the act entitled "An act to provide for the better organization of the pay department of the navy," approved May 3d 1866, may be made from the number of acting assistant paymasters of the navy, who performed duty as acting assistant paymasters during the war, and who at the time of their appointment under this act shall not be over the age of thirty-two years.

101. That the president of the United States be and is hereby authorized to waive the examination of such officers in the pay department of the navy as are on duty abroad, and cannot at present be examined, as required by law: Provided, That such examinations as are required by law shall be made, as soon as practicable after the return of said officers to the United States; and no officer found to be disqualified shall receive the promotion contemplated in the act herein referred to.

VI. ENGINEERS.

102. That the following general order issued by the secretary of the navy, and dated January 13th 1859, be and the same is hereby confirmed.

"General Order.

Chief engineers of more than twelve years will rank with commanders.

Chief engineers of less than twelve years, with lieutenants.

First assistant engineers, next after lieutenants.

Second assistant engineers, next after masters.

Third assistant engineers, with midshipmen.

Commanding and executive officers of whatever grade, will take precedence over all engineer officers.

This order confers no authority to exercise military command, and no additional right to quarters.

103. In case of a vacancy in the office of engineer-in-chief of the navy, the appointment thereto shall be made from the list of chief engineers.

104. The number of chief engineers shall not exceed one for each first and second rate vessel in the navy, with such first, second and third assistant engineers, or those acting as such, as the wants of the service actually require.

VII. PAY AND SUBSISTENCE.

105. The annual pay of the officers of the navy, on the active list, hereinafter named, shall be as follows:

Captains. The senior flag officer, created under and by virtue of an act of congress approved March 2d 1857, (a) shall receive four thousand five hundred dollars.

106. Chaplains.-Chaplains shall be paid as lieutenants.

Every chaplain shall be permitted to conduct public worship according to the man

Every chaplain retained in the service shall be required to report annually, to the

secretary of the navy, the official services performed by him.

112. Warranted Officers.-Every boatswain, gunner, carpenter and sailmaker on duty at sea, for the first three years' sea service after the date of his warrant, one thousand dollars.

For the second three years' sea service after the date of his warrant, one thousand one hundred and fifty dollars.

For the third three years' sea service after the date of his warrant, one thousand two hundred and fifty dollars.

For the fourth three years' sea service after the date of his warrant, one thousand three hundred and fifty dollars.

For twelve years' sea service and upwards, one thousand four hundred and fifty dollars.

When on other duty.-For the first three years of sea service after the date of warrant, eight hundred dollars.

For the second three years' sea service after the date of his warrant, nine hundred dollars.

113. Nothing in this act contained shall be so construed as to increase or modify the present pay of chiefs of bureaus in the navy department, with whom shall be classed the present superintendent of the naval observatory: [Provided, That the officer now charged with experiments in gunnery at the navy yard, Washington, shall receive the sea service pay of the grade now next above him.] (b)

114. Hereafter no service shall be regarded as sea service but such as shall be performed at sea under the orders of a department, and in vessels employed by authority of law.

115. Nothing in this act contained shall be held to modify or affect the existing power of the secretary of the navy to furlough officers, or to affect the furlough pay.

116. The increased pay herein before provided for masters shall attach to masters not in the line of promotion, whether on the active or reserved list; and officers on the reserved list, when called into active service, shall receive the pay of their respective grades as herein provided, during the term of such service: Provided, That nothing herein contained shall be construed to change or modify the present pay of officers on the reserved list, either on leave or furlough.

117. The payments heretofore made to the clerks of yards and the commandants' clerks at the navy yards of Kittery and Philadelphia, under appropriations made by congress for that purpose, at the rate of twelve hundred dollars per annum, are hereby allowed and confirmed.

118. When increased

130. Whenever any officer of the navy, of a class subject by law or regulation to examination before promotion to a higher grade, shall have been absent on duty at the time when he should have been examined, and shall have been found qualified at a sub- pay to comsequent examination, the increased rate of pay to which he may be entitled shall be allowed to him, from the date when he would have received it, had he been found qualified at the time when his examination should have taken place.

131. In calculating the graduated pay of boatswains, gunners, carpenters and sailmakers in the navy, as established by law, the sea service shall be computed from the dates of their appointments or entry into the service in their respective grades, in lieu of the dates of their warrants.

132. All officers while at sea, or attached to a sea-going vessel, shall be allowed one ration.

133. And no ration shall be allowed to any officers of the navy on the retired list.
