And on his name being called, answered in the affirmative on each question.

Mr. Hunt presented the memorial of citizens of Defiance, in Williams county, relative to the application for divorce of Alexander Beatty, from his wife, Lavina Catharine Beatty; which was referred to the standing committee on the Judiciary.

Mr. Faran presented the petition of Benjamin G. Levi, of Hamil ton county, O., praying for a change of his name; which was referred to Mr. Faran.

Mr. Carpenter presented the petition of certain house holders, citizens of Medina county, O., praying the erection of a new school district; which was referred to the standing committee on Schools and School Lands.

Mr. Taylor presented the petitions of citizens of Licking county, praying further protection to religious meetings; which were referred to the standing committee on the Judiciary.

The Speaker presented the annual report of the Secretary of State; which was laid upon the table.

Mr. Faran, from the select committee on the subject, reported a bill (S. No. 2) to vest in the trustees of school district No. 2, in Fulton township, Hamilton county, Ohio, certain escheated lands therein, for common school purposes; which was read the first time.

Mr. Faran, from the select committee on the subject, reported a bill (S. No. 3) to change the name of Benjamin G. Levi, to that of Benjamin Leiber; which was read the first time.

Mr. Sill, from the select committee on the subject, reported a bill (S. No. 4) to incorporate the Phi Delta Society of Western Reserve College; which was read the first time.

The following bill of the Senate was read a second time, committed to a committee of the whole Senate, and made the order of the day for this day, to wit:

No. 1; A bill to extend to the county of Summit, the provisions of an act passed December 27, 1834, entitled an act to amend the act for opening and regulating roads and highways, and repealing an act to amend the same, passed February 25, 1833.

Message from the House of Representatives. Mr. Speaker:

The House of Representatives have passed the following resolution, in which they ask the concurrence of the Senate.

Resolution in relation to the compensation of the late Sergeant-at

arms.

The House have agreed to the resolution of the Senate, on the sub

ject of appointing a joint select committee, with one amendment; filling the blank with the number "ten."

The resolution of the House was referred to the standing committee on Claims.

The amendment of the House to the resolution of the Senate, was agreed to, and the House were informed thereof.

Mr. Leonard, pursuant to previous notice, asked and obtained leave, and introduced a bill (S. No. 5) to repeal an act to amend the act entitled, an act to incorporate the Theological Seminary of the Protestant Episcopal Church, in the diocese of Ohio; which was read the first time.

Message from the House of Representatives. Mr. Speaker:

The following bills have been reported to the House and read the first time, to wit:

(1.) A bill to repeal so much of an act therein named, as prohibits the reception, as dues of the State, by county treasurers and others, of bank bills of a less denomination than five dollars.

(2.) A bill for the divorce of Flavia J. Hurlburt, from her husband, William H. Hurlburt.

(3.) A bill for the relief of the purchasers of school section, No. 16, in Smithfield township, in the county of Jefferson.

Mr. Faran offered for adoption the following resolution, to wit: Resolved by the Senate, That the committee on Privileges and Elections, in the matter of the contested election of George W. Holmes to a seat in the Senate of Ohio, by John C. Wright, Esq., be and they are hereby empowered to send for persons and papers, and examine witnesses under oath; and that during such investigation said committee have leave of absence from the hall of the Senate.

Mr. Thomas moved that the resolution do lie upon the table; which was agreed to.

Message from the House of Representatives. Mr. Speaker:

The House of Representatives have permanently organized by electing Seabury Ford, Esq., Speaker; John M. Gallagher, Clerk, and Charles Chapman, Door-keeper and Sergeant-at-arms, to serve during the present session.

The hour of three o'clock, P. M., having arrived, the Senate, in accordance with the provisions of a resolution previously passed, proceeded to the election of officers to serve for and during the present

session, and upon counting the ballots given for Speaker, there appeared for,

William M'Laughlin, having received all the votes given, was declared to be duly elected Speaker of the Senate, and accordingly took the chair, and returned his thanks to the Senators.

The Senate next proceeded to elect a Clerk, and the following was the result of the first ballot, to wit:

C. J. M'Nulty, having received a majority of all the votes given, was, by the Speaker of the Senate, declared to be duly elected, and having taken the oath of office, proceeded to the discharge of his duties.

The Senate then elected a Door-keeper and Sergeant-at-arms, by the following vote, to wit:

For Samuel Burwell.

....... 34 votes.

Samuel Burwell, having received all the votes given, was, by the Speaker of the Senate, declared to be duly elected Door-keeper and Sergeant-at-arms, and having been qualified, proceeded to the performance of his duties.

Mr. Bissell offered for adoption the following resolution, to wit:

Resolved by the Senate and House of Representatives of the State of Ohio, That no Senator or Representative of this legislature ought, during his term of office, to be elected or appointed to any office, trust, or honor, which, by the constitution and laws of Ohio, the legislature have the power to elect or appoint.

On motion of Mr. Bissell,

The resolution was laid upon the table.

The Speaker laid before the Senate the abstracts of the votes given in the several counties of this State, for Governor, at the last annual election; which were laid upon the table.

On motion of Mr. Green,

The resolution providing for opening and publishing the votes for Governor at the last annual election, was taken up, and adopted, and sent to the House for concurrence.

The Speaker announced the following as the committee on the part of the Senate, under the resolution raising a joint select committee on the subject of fixing the times of holding the judicial courts, to wit: Messrs. Green, Glover, Godman, Patterson and Bissell.

On motion of Mr. Humphreys,

The memorial of Jesse Howard, of Washington county, praying for certain remuneration, was taken up, and referred to the standing committee on the Judiciary.

Mr. Carpenter gave notice, that on to-morrow, or some subsequent day of this session, he would ask leave to bring in a bill for the incorporation of the Medina County Mutual Fire Insurance Company.

On motion of Mr. Patterson,

The Senate resolved itself into a committee of the whole, Mr. Spangler in the chair, on the bill (S. No. 1) to extend to the county of Summit the provisions of an act passed December 27, 1834, and entitled, "an act to amend the act for the opening and regulating roads and highways," and repealing an act to amend the same, passed February 25, 1833; and after some time, the committee rose, and reported the same back without amendment.

On motion of Mr. Glover,

Said bill was then referred to the standing committee on the Judiciary.

On motion of Mr. Taylor,

The resolution providing for printing certain copies of the Governor's message, in the Welch language, was taken up.

And upon the question of its adoption, he demanded the yeas and nays, which were ordered, and were, yea 1-nays 35-as follows, to wit:

Nays-Messrs. Barnett, Bissell, Carpenter, Crowell, Faran, Glover, Godman, Goodin, Green, Harris, Hazeltine, Henderson, Holmes, Hostetter, Hough, Humphreys, Hunt, Leonard, Lord, Mitchell, Nash, Patterson, Perkins, Ream, Root, Scott, Shannon, Sill, Spangler, Thomas, Thompson, Utter, Vance, Waddle and Speaker-35. So the Senate refused to pass the resolution.

On motion of Mr. Utter,

The following resolution was adopted, to wit:

Resolved by the General Assembly of the State of Ohio, That the sum of twenty five dollars be and the same is hereby allowed Samuel Burwell, for repairing the Senate chamber for the reception of the members of the present General Assembly, to be provided for in the gen. eral appropriation for members of the General Assembly.

Ordered to the House for concurrence.

Mr. Utter, on leave, from the standing committee on Claims, reported back the resolution of the House providing for the payment of Jacob Harper, Esq., late Sergeant-at-arms of the House, for preparing the hall of the House of Representatives for the reception of the members of the present session, which had been referred to said committee, without amendment; and the resolution was then considered and adopted, and the House were informed thereof.

On motion of Mr. Utter,

The Senate then adjourned.

The Senate met pursuant to adjournment.

Mr. Hostetter presented the petition of citizens of Stark county, in relation to the division of a certain half school section; which was referred to the standing committee on Schools and School lands.

Mr. Barnett presented the memorial of Ezra Pretzman, of Montgomery county, Ohio, praying to be divorced from his wife, Susan Pretzman; which was referred to the standing committee on the Judiciary.

Mr. Harris presented the memorial of citizens of Wayne county, praying further protection to religious meetings; which was referred to the standing committee on the Judiciary.

Mr. Crowell presented the petition of citizens of Trumbull county, Ohio, praying the incorporation of a certain church; which was referred to Mr. Crowell.

Mr. Thomas presented the petition of John Lavy, of Miami county, praying to be divorced from his wife, Eleanor Lavy; which was referred to the standing committee on the Judiciary.

Mr. Henderson presented the petition of citizens of Muskingum county, praying further protection to religicus meetings; which was referred to the standing committee on the Judiciary.

Mr. Hunt presented a petition from citizens of Lucas county, praying further protection to religious societies; which was referred to the standing committee on the Judiciary.

The Speaker presented the memorial of Jonas H. Gearhart, Esq. of Richland county, executor of William Lawson, dec'd., praying an extension of time on the purchase of certain Virginia Military School Lands; which was referred to the standing committee on Schools and School Lands.

Mr. Bissell, from the standing committee on the Judiciary, to which was referred the bill (S. No. 1) to extend to the county of Summit, the provisions of an act passed December 27, 1834, and entitled "an act to amend the act for opening and regulating roads and highways," and repealing an act to amend the same, passed February 25, 1835, reported the same back with sundry amendments, which were agreed to, and the bill was further amended, and ordered to be engrossed for its third reading to-morrow, in order to its final passage.

Mr. Crowell, from the select committee on the subject, reported a bill (S. No. 6) to incorporate the First Freewill Baptist Church and Society, in the township of Mecca, in the county of Trumbull; which was read the first time.

The following bills were read a second time, committed to a committee of the whole Senate, and made the order of the day for this day, to wit:

(S. No. 2,) A bill to vest in the Directors of School District No. 2, in Fulton township, Hamilton county, Ohio, certain escheated lands therein, for common school purposes;
