CHANGING THE NAME OF CULBERTSON DAM ON THE REPUBLICAN

RIVER IN THE STATE OF NEBRASKA TO TRENTON DAM AND TO NAME THE BODY OF WATER ARISING BEHIND SUCH DAM SWANSON LAKE

Mr. PETERSON, from the Committee on Public Lands, submitted the following

REPORT

[To accompany S. 270]

The Committee on Public Lands, to whom was referred the bill (S. 270) to change the name of Culbertson Dam on the Republican River in the State of Nebraska to Trenton Dam and to name the body of water arising behind such dam Swanson Lake, having considered the same, report favorably thereon without amendment and recommend that the bill do pass.

EXPLANATION OF THE BILL

The purpose of this bill is to change the name of the Culbertson Dam on the Republican River in Nebraska to Trenton Dam and to name the body of water arising behind the dam Swanson Lake.

This change is requested by local interests because the dam is being constructed near the town of Trenton, Nebr., instead of near the town of Culbertson as originally contemplated. Swanson Lake will be so named in commemoration of Mr. Carl H. Swanson, a Nebraska resident who was active in developing the Republican River Valley. The Department of the Interior has approved the proposed change of name. The Department's report to the Senate Committee on Interior and Insular Affairs is set forth below and is made a part of this report:

MY DEAR SENATOR O'MAHONEY: We are glad to comply with the request of the Committee on Interior and Insular Affairs for a report on S. 270, a bill to change the name of Culbertson Dam on the Republican River in the State of Nebraska to Trenton Dam.

This Department will interpose no objection to the enactment of the bill.

It had been proposed originally to locate the dam in question at a point on the Republican River near the town of Culbertson, Nebr. However, further investigations revealed that a better site for the dam would be near the town of Trenton, Nebr.

Certain local interests have expressed to this Department a desire to have the dam named after the late Carl Helga Swanson, in recognition of his work in the development of the Republican River Valley.

We have been informed by the Bureau of the Budget that there is no objection to the submission of this report to your committee.

AUTHORIZING THE ISSUANCE OF A PATENT IN FEE TO THOMAS A. PICKETT

The Committee on Public Lands to whom was referred the bill (S. 392) authorizing the issuance of a patent in fee to Thomas A. Pickett, having considered the same, report favorably thereon without amendment and recommend that the bill do pass.

EXPLANATION OF THE BILL

This bill would authorize the Secretary of the Interior to issue to Thomas A. Pickett of Berkeley, Calif., a patent in fee for the remaining lands in his allotment on the Crow Indian Reservation in Montana. Enactment of this legislation is recommended by the Secretary of the Interior. Congressional approval is required since Mr. Pickett's allotment consists of 638.73 acres of land and existing law prohibits a Crow Indian allottee from selling more than one-half, or 320 acres, of his allotment.

Mr. Pickett has not lived on the Crow Reservation for many years. The Department feels that he is qualified to conduct his affairs without governmental supervision or protection.

MY DEAR SENATOR O'MAHONEY: Reference is made to your request for a report on S. 392, a bill authorizing the issuance of a patent in fee to Thomas A. Pickett, Crow Indian allottee.

I have no objection to the enactment of this bill.

The bill would authorize and direct the Secretary of the Interior, upon application in writing, to issue a patent in fee to Thomas A. Pickett for the remaining lands in his allotment No. 90 on the Crow Reservation, comprising his homestead of 638.73 acres. The act of June 4, 1920 (41 Stat. 751), provides that a Crow Indian allottee shall not sell more than one-half of his homestead, or 320 acres thereof. For this reason the enactment of legislation as proposed is necessary to authorize the allottee to sell all of his land.

It appears that Mr. Pickett is qualified to conduct his affairs without governmental supervision or protection. Mr. Pickett's land does not have any stock water on it and the superintendent has reported that its sale would not interfere with the future consolidation or administration of Indian trust lands in that area. Mr. Pickett is of one-half Indian blood and has made his living away from the Crow Reservation for a good many years.

The Bureau of the Budget has advised me that there is no objection to the submission of this report to your committee.

SELL THE LAND OF GEORGE PETERS UNDER EXISTING REGULATIONS

The Committee on Public Lands, to whom was referred the bill (S. 716) authorizing the Secretary of the Interior to sell the land of George Peters under existing regulations, having considered the same, report favorably thereon without amendment and recommend that the bill do pass.

EXPLANATION OF THE BILL

The purpose of this bill is to authorize the Secretary of the Interior to sell to a Crow Indian the 840 acres of land on the Crow Indian Reservation, Mont., now owned by George Peters.

The Secretary of the Interior recommends that this bill be enacted into law. The land concerned is located in a predominantly Indianowned area and its sale to a non-Indian might present administrative problems. However, the proposed buyer is a Crow Indian and the Department of the Interior favors the sale.

As originally introduced, S. 716 provided for the issuance of a patent in fee to Mr. Peters. At the suggestion of the Department of the Interior, the Senate Committee on Interior and Insular Affairs amended the bill so as to permit the Secretary to sell the land under existing regulations. The Department's report to the chairman of the Senate committee is herein below set forth in full:
