(purchasing trustees), their executors, admini- PURCHASES. strators, and assigns, for all the residue and remainder which shall be then to come and unexpired of the said term, upon and for the trusts and purposes hereinafter declared, expressed or referred unto concerning the same, or such of them as shall be then subsisting or capable of taking effect, in such manner and form as they the said (purchasing trustees), their executors, administrators, or assigns, or other the trustees or trustee of the said premises for the time being, or his or their counsel in the law (being of the degree of a barrister), shall lawfully and reasonably advise and require. AND in consideration of the premises aforesaid, Covenant by the said (purchasing trustees) do hereby, for them- payment of selves, their executors, administrators, and assigns, covenant, promise and agree with and to the said (trustees for sale) and (lessee) respectively, their and each of their executors and administrators, in manner following (that is to say), that they the said (purchasing trustees), their executors, administrators, and assigns, or some or one of them, shall and will from time to time, and at all times hereafter during the residue or remainder which is now to come and unexpired of the said term or period of years, or during such part or portion thereof, as they shall or lawfully may have and enjoy peaceable and quiet possession, under or by virtue of these presents, of the messuages, ground and premises expressed to be hereby assigned, according to the true intent and meaning hereof, against the said (trustees for sale) VOL. Trustees to PURCHASES. and (lessee) and every of them, and all and every person and persons rightfully claiming from or under, or in trust for them as aforesaid, well and truly pay or cause to be paid the yearly rent of £ in and by the said hereinbefore in part recited indenture of lease reserved, at such times and in such manner as the same is thereby reserved and henceforth made payable; and also observe and perform all and every the covenants, provisoes, clauses, conditions, and agreements therein contained, which from henceforth during the said term or period, are or ought to be performed and observed, for and in respect of the said premises, or of any part thereof, and shall and will from time to time and at all times hereafter protect, defend, keep harmless and indemnified the said (trustees for sale) and (lessee) and each of them, their and each of their executors and administrators, and their and every of their lands and tenements, goods, chattels, and effects, from and against the same rents, covenants, and agreements, and of and from all actions, suits, costs, damages, and expenses whatsoever, which they or any or either of them, shall or may pay or sustain, or which shall or may arise or be occasioned by the non-payment, non-performance, or non-observance thereof respectively, or of any of them (1).
